Terms of Service Agreement

Welcome to Peanut, a plant-based coaching service operated by Get Your Oink On, LLC ("Peanut," "we," "us," or "our"). By creating an account, enrolling in the Service, or receiving any portion of the coaching experience, you ("PigPal," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

These Terms govern your receipt and use of Professional AI-Generated Coaching Insights and all associated coaching content, features, and functionality delivered through getyouroinkon.com and any associated mobile application (collectively, "the Peanut Service"). Your enrollment purchases a professional coaching result — not a license to use software.

1. Definitions and Service Terminology

The following defined terms apply throughout these Terms and throughout the Peanut Service.

"Professional AI-Generated Coaching Insights"

The personalized, AI-produced guidance, motivational content, reflective prompts, behavioral nudges, and progress commentary generated by the Peanut coaching engine in response to your inputs. These Insights are intended to support your plant-based lifestyle journey and are not a substitute for licensed medical, nutritional, or mental health advice.

"The Service"

The full suite of features, tools, and content delivered through the Peanut Service, including Professional AI-Generated Coaching Insights, the Oinkometer, the Whole Hog Challenge, SnortCard check-ins, Snort Reports, the Rooting Ground content hub, the PigPen Message Center, and all related functionality.

"PigPal"

Any registered user of the Peanut Service, regardless of service retainer tier. All PigPals are members of the Peanut community, collectively referred to as "the herd."

"Coaching PigPal"

A PigPal enrolled in the full Peanut coaching retainer, receiving ongoing Professional AI-Generated Coaching Insights and all associated coaching features.

"Ally"

A PigPal enrolled in the Ally support retainer, designed for individuals who wish to support a Coaching PigPal's plant-based journey without receiving personal coaching.

"Oinkometer"

The proprietary progress-tracking system within the Peanut Service that measures and reflects a PigPal's plant-based lifestyle engagement over time. Oinkometer data informs the personalization of Professional AI-Generated Coaching Insights.

"SnortCard"

A structured personal profile tool used by PigPals to provide context for their coaching experience. SnortCard data is used by Peanut to calibrate Professional AI-Generated Coaching Insights.

"Snort Report"

An AI-generated periodic coaching summary delivered to a PigPal's PigPen Message Center, synthesizing recent engagement data and providing forward-looking guidance.

"The Rooting Ground"

Peanut's curated plant-based content hub, including the Resource Trough, Peanut's Feed, and the Pig Tales blog. Content in the Rooting Ground is provided for informational and inspirational purposes.

"PigPen Message Center"

Peanut's internal messaging center, where PigPals receive Snort Reports, system notifications, and other communications from the Service.

"Daily Oink"

Peanut's opt-in daily email series delivering plant-based encouragement, tips, and curated content to PigPals.

"Whole Hog Challenge"

A structured, day-specific coaching program available to PigPals, featuring progress milestones, reflection capture, and themed Professional AI-Generated Coaching Insights.

"Sanctuary Partner"

An animal sanctuary organization selected by Peanut as a beneficiary of a portion of service retainer revenue. Sanctuary Partners are featured on Peanut's public Sanctuary Spotlight page.

"Snout Sponsor"

A PigPal who purchases a gifted coaching retainer on behalf of another individual (the "Gift Recipient"), enabling that person to receive the Service.

"Proprietary Coaching Engine"

The artificial intelligence system operated by Peanut to generate Professional AI-Generated Coaching Insights. The Proprietary Coaching Engine is a tool used internally by Peanut to deliver coaching outputs. It is not a product licensed, sold, or transferred to PigPals. PigPals receive no ownership interest or license in or to the Proprietary Coaching Engine.

"Service Agreement for Personalized Coaching Outputs"

The true object of the contractual relationship between Peanut and each PigPal. By enrolling, a PigPal is not purchasing, licensing, or renting software. The PigPal is engaging Peanut for the delivery of professional coaching outputs — specifically, Professional AI-Generated Coaching Insights — produced by Peanut using its Proprietary Coaching Engine as an internal service delivery tool.

2. Nature of the Service — Professional AI-Generated Coaching Insights

Peanut is a professional coaching service. The technology infrastructure underlying the Peanut Service — including its Proprietary Coaching Engine, databases, and software systems — exists solely as the internal mechanism by which Peanut produces and delivers a professional coaching result to you. You are not purchasing, licensing, or renting software or a technology service. You are engaging Peanut under a Service Agreement for Personalized Coaching Outputs and receiving Professional AI-Generated Coaching Insights as the deliverable of that engagement.

The Proprietary Coaching Engine is Peanut's internal tool. Its use is analogous to a human consulting firm using proprietary research software to produce a client deliverable — the client engages the firm for the result, not for access to the firm's internal tools. You understand and agree to the following regarding your coaching Insights:

What Professional AI-Generated Coaching Insights Are

Personalized responses generated by an artificial intelligence system trained to support plant-based lifestyle adoption and maintenance.
Motivational, behavioral, and reflective content calibrated to your stated goals, SnortCard profile, Oinkometer history, and coaching interactions.
Non-prescriptive guidance designed to meet you where you are, in alignment with Peanut's "progress over perfection" philosophy.
Dynamic content that evolves in response to your engagement patterns and check-in data over time.

What Professional AI-Generated Coaching Insights Are Not

Professional AI-Generated Coaching Insights do not constitute licensed medical, dietary, nutritional, psychological, or therapeutic advice.
They are not a substitute for consultation with a qualified healthcare provider, registered dietitian, or licensed counselor.
They do not represent the opinions of any human coach, employee, or representative of Peanut.
They are not guaranteed to be accurate, complete, or appropriate for every individual's health circumstances.

By using the Service, you assume full responsibility for how you act upon Professional AI-Generated Coaching Insights. Peanut expressly disclaims liability for any outcomes resulting from reliance on AI-generated content.

3. Professional Coaching Service Retainer and Billing

Peanut delivers its coaching services on a monthly service retainer basis. Each billing cycle represents the delivery of ongoing Professional AI Coaching Services for that period — not a recurring charge for software access, technology use, or a per-seat license. The following service tiers are in effect as of the Effective Date:

Full Coaching Retainer (PigPal): $12.99/month (Founding Member rate); $17.99/month standard rate after the founding period closes. Delivers Professional AI Coaching Services including personalized Insight generation, Oinkometer coaching, Whole Hog Challenge participation, SnortCard coaching, periodic Snort Reports, PigPen Message Center, and the Rooting Ground content experience.
Ally (Companion Service Retainer): $4.99/month. Delivers participation in the Service as a support-tier coaching companion, without personal Professional AI-Generated Coaching Insights.
Gifted Coaching Retainer (Snout Sponsor): Snout Sponsors may purchase a full coaching retainer on behalf of a Gift Recipient. Gift Recipient onboarding proceeds without payment entry. Snout Sponsors are responsible for all billing associated with the gifted retainer.

Monthly coaching service retainers are billed on a recurring basis through our payment processor, Stripe. You authorize Peanut to charge your payment method on a recurring basis until you cancel. All charges are non-refundable except as required by applicable law.

Peanut reserves the right to modify retainer pricing with thirty (30) days' prior notice to enrolled PigPals.

Invoice Descriptor and Billing Line Items

All charges processed through Stripe will appear using service-oriented billing descriptors consistent with the nature of this Service Agreement for Personalized Coaching Outputs. Approved billing line-item language includes:

"Professional AI Coaching Services"
"Personalized Insight Generation — Monthly Retainer"
"AI-Assisted Strategic Coaching Services"
"Plant-Based Coaching Service — Monthly Retainer"

The following descriptors are expressly not used, as they mischaracterize the nature of the service: "AI Coaching Software Subscription," "Platform License," "Monthly Access Fee," or "SaaS Subscription."

Invoice descriptors are configured at the provider level. PigPals may request a copy of any invoice through Stripe's hosted invoice portal, a link to which is included in billing confirmation emails.

4. Account Access and Authentication

Peanut uses passwordless authentication via magic links delivered to your registered email address. You are responsible for maintaining access to the email account associated with your Peanut account. Peanut is not liable for access issues arising from loss of email access, delivery failures, or unauthorized account activity.

You agree to provide accurate registration information and to notify Peanut promptly of any unauthorized access to your account. Each account is for a single individual's use and may not be shared.

5. Service Retainer Lifecycle — Pause, Cancellation, and Reinstatement

Pausing Your Service Retainer

Eligible PigPals may pause their coaching service retainer for a defined period through Peanut's retainer management tools. During a pause, delivery of Professional AI-Generated Coaching Insights and coaching features is suspended. Service delivery will resume automatically at the end of the pause period.

Cancellation

You may cancel your coaching service retainer at any time through your account settings. Cancellation takes effect at the end of the current billing period. Following cancellation, your account will be designated as inactive and coaching service delivery will be suspended. Cancellation data, including the reason provided, may be used to improve the Service.

Reinstatement

Formerly enrolled PigPals who choose to reactivate their coaching retainer will be guided through a reinstatement onboarding experience and may receive a new set of coaching seeds to re-establish their Professional AI-Generated Coaching Insights experience.

6. Sanctuary Partner Program and Giving

Peanut is committed to supporting animal sanctuaries. We feed Peanut. Peanut feeds animal sanctuaries. A portion of net service retainer revenue supports our Sanctuary Partners — vetted animal sanctuary organizations featured on Peanut's public Sanctuary Spotlight page.

The Sanctuary Partner program does not alter your retainer billing. Revenue contributions are made at Peanut's discretion and are subject to change. Peanut does not guarantee specific contribution amounts in any billing period.

7. User Content and Data

By using the Service, you provide us with content including SnortCard entries, coaching conversation inputs, check-in data, and profile information (collectively, "User Content"). You retain ownership of your User Content. By submitting User Content, you grant Peanut a limited, non-exclusive license to use that content solely to provide and improve the Service, including to generate Professional AI-Generated Coaching Insights. For the avoidance of doubt, no software license, technology license, or intellectual property license of any kind is granted by Peanut to you under this Agreement. The only right conveyed is the right to receive the coaching outputs described herein.

Peanut does not sell your personal data to third parties. We use your data to operate the Service, personalize your coaching experience, and communicate with you about your account. Please review our Privacy Policy for full details.

8. Prohibited Uses

You agree not to engage the Peanut Service in any way that:

Attempts to reverse-engineer, scrape, or reproduce the Professional AI-Generated Coaching Insights system or any underlying technology.
Harasses, threatens, or harms other members of the herd or Peanut staff.
Misrepresents your identity or provides false registration information.
Violates any applicable local, state, national, or international law or regulation.
Attempts to gain unauthorized access to any portion of Peanut or its related systems.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PEANUT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEANUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON PROFESSIONAL AI-GENERATED COACHING INSIGHTS.

10. Modifications to These Terms

Peanut reserves the right to update these Terms at any time. When we do, we will revise the Effective Date at the top of this document and, where the changes are material, notify you by email to your registered address. Your continued use of the Service following notice of changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in El Paso County, Colorado.

12. Service Classification

Nature of Engagement

This Agreement is a Service Agreement for Personalized Coaching Outputs, not a software license agreement, SaaS agreement, or technology access agreement.
Peanut provides a professional coaching result. The Proprietary Coaching Engine used to produce that result is an internal tool of the provider and is not transferred, licensed, or made available to PigPals.
PigPals engage Peanut for coaching outcomes — not for use of, access to, or a seat in any software system.

Billing and Invoice Classification

All charges billed under this Agreement represent fees for Professional AI Coaching Services delivered during the applicable service period.
Charges are not fees for software subscriptions, platform licenses, SaaS access, per-user seats, or technology rentals of any kind.
Invoice line items are designated accordingly (see Section 3, Invoice Descriptor and Billing Line Items).

Marketing and Public Representation

Peanut's public-facing materials — including its website, email communications, and in-app copy — describe the Service in outcome-oriented, service-first language consistent with this Agreement. References to Peanut's technology describe it as a proprietary AI-driven service delivery mechanism, not as a software product offered to end users. PigPals acknowledge that they enrolled based on the coaching outcomes Peanut delivers, not on the basis of receiving a software product.
